The following is suggested wording for supporting the work of the West Texas Rehabilitation Center in your will. Very easily these words can be placed in your will or in an amendment to your will called a codicil. If you have any questions before you take this to your attorney, please call the Foundation office toll free at 888-861-6385 or at one of the numbers listed at the bottom of this page. If the phrasing below does not meet your specific needs, please ask for additional information. If you do not have an attorney, or would like assistance in getting this done, please contact us. To minimize income taxes your heirs might have to pay on certain assets:
I instruct that all of my charitable gifts, bequests and devises shall be made, to the extent possible, from property that constitutes "income in respect of a decedent" as that term is defined under the U.S. income tax laws.
If you want to leave a percentage of your estate:
I give, devise, and bequeath to West Texas Rehabilitation Center Foundation, Abilene and San Angelo, Texas, ____ % of my estate.
If you want to leave a specific dollar amount:
I give, devise and bequeath to West Texas Rehabilitation Center Foundation, Abilene and San Angelo, Texas, $_______.
If you want to leave the residue of your estate; that is, the amount remaining after you have provided for your heirs and/or other beneficiaries:
All the rest and residue of my estate, including real and personal property, I give, devise and bequeath to West Texas Rehabilitation Center Foundation, Abilene and San Angelo, Texas.
If you want to leave a specific piece of property:
I give, devise and bequeath to West Texas Rehabilitation Center Foundation, Abilene and San Angelo, Texas, (a description of the property) located at (exact location).
If you want to leave specific personal property:
I give and bequeath to West Texas Rehabilitation Center Foundation, Abilene and San Angelo, Texas, (a description of the personal property).
Your attorney may prefer you not specifically list in your will the personal effects you wish to leave to others or the Rehab, but instead may prefer to state:
My interest in certain personal property shall be distributed in accordance with the provisions of a memorandum written entirely in my handwriting and signed by me. If for any reason said memorandum is not filed with this Will, or to the extent that such property is not disposed of by such memorandum, then all of said property not so disposed of shall be distributed to (heir or beneficiary).
Many of the Rehab's friends have benefited greatly from ideas that we have shown them and their advisors. Some have been able to conserve their assets for those they love; some have reduced or avoided taxes while others have increased their income. Sometimes, there may be ways of giving which are much more beneficial than through a will. Now, as you revise your plans, may be the perfect time to ask some questions. You'll get honest answers at no cost, no obligation and no expectation.
Your will may very well be the most important document of your life; by all means, please make sure your will is written by an attorney competent in this area of law. DO NOT ATTEMPT TO WRITE THE WILL YOURSELF.
